History Cat License Agreement
The History Cat is built to support educators with high-quality, engaging, and affordable lessons designed for single-classroom use. Our goal is to make history approachable, meaningful, and usable in real classrooms by creating resources that are thoughtfully researched, clearly structured, and ready to teach. We believe teachers deserve well-crafted materials that respect their time and budgets while supporting sustainable creation of content that continues to grow and improve.
By purchasing and accessing any digital product, the buyer acknowledges and agrees to this policy in full.
I. Fair Use and License Terms
All History Cat content, including but not limited to lessons, articles, worksheets, games, digital activities, graphics, and assessments (collectively, the “Materials”), is protected by United States copyright law.
Purchase or access to the Materials grants the purchaser a limited, non-exclusive, non-transferable, revocable license for single classroom use only, subject to the terms below.
a. Authorized Use
The license permits the purchaser to:

Use the Materials for instructional purposes within one classroom, defined as one teacher instructing one group of students.

Reproduce and distribute the Materials solely to students enrolled in that classroom, whether in print or digital form.

Upload the Materials to a password-protected learning management system or class website accessible only to the enrolled students of the licensed classroom.
b. Restrictions
The purchaser shall not:

Share, distribute, sublicense, sell, transfer, or otherwise make the Materials available to any other teacher, classroom, department, school, or third party.

Upload the Materials to any publicly accessible website, shared drive, curriculum repository, or school-wide or district-wide platform.

Post the Materials to teacher portals, professional learning communities, social media platforms, or file-sharing services.
-
Share login credentials, access links, or passwords associated with History Cat content.

Modify, adapt, or create derivative works for redistribution or commercial use.
c. License Scope
Each license applies to one classroom only. Use by multiple teachers, multiple class sections, multiple grade levels, or multiple schools requires the purchase of additional licenses, one per classroom.
d. Fair Use Disclaimer
Nothing in these terms grants permission to rely on “fair use” to reproduce or distribute the Materials in lieu of purchasing a license. Limited quotation for purposes of commentary, criticism, or review may be permitted under applicable law; however, reproduction of full lessons or instructional materials is expressly prohibited.
e. Termination
Violation of these terms may result in immediate termination of the license without refund and may subject the user to legal remedies, including financial damages, available under copyright law.
f. Ownership
All rights, titles, logos, and interest in the Materials remain the exclusive property of The History Cat and are not intended to be modified or reproduced without express written permission by the content creator.
II. Return & Refund Policy for Digital Products
All products sold are digital goods. Due to the nature of digital products, all sales are final. Digital products cannot be returned, exchanged, or “given back” to the creator once access has been granted.
a. Refund Eligibility
Refunds are granted only under limited and exceptional circumstances, specifically when a digital product is determined to be defective and the defect cannot be satisfactorily resolved after reasonable troubleshooting efforts.
b. Required Steps Before a Refund Request
Before requesting a refund, the buyer must:

Contact the seller directly and provide a clear description of the issue, including relevant details such as error messages, screenshots, or access problems.

Allow a reasonable period of time for the seller to attempt troubleshooting and resolution.
Failure to complete these steps will result in the refund request being denied.
c. Resolution and Discontinuation of Use
If a refund is approved due to an unresolved defect, the buyer agrees to:

Immediately discontinue all use of the digital product.

Remove all copies, links, uploads, and references to the product from any private classroom platforms, learning management systems, websites, or digital storage locations.

Confirm compliance if requested by the seller.
d. Non-Refundable Circumstances
Refunds will not be issued for reasons including, but not limited to:

User error or lack of familiarity with the product

Compatibility issues not specified in the product description

Changes in classroom needs, curriculum, or teaching plans
-
Failure to read product descriptions or instructions prior to purchase
III. Term and Duration
Unless otherwise stated at the time of purchase, the license granted for History Cat Materials is perpetual for the licensed classroom, subject to continued compliance with these terms. The license automatically terminates upon any breach of this agreement, at which point all use of the Materials must cease.
IV. Updates and Revisions
The History Cat may, at its discretion, update, revise, or modify the Materials. Minor updates or corrections may be provided without additional charge. Substantial revisions, new editions, or materially expanded content may require the purchase of a new or additional license. The History Cat is under no obligation to provide updates unless expressly stated.
V. Disclaimer of Warranties
The Materials are provided “as is” and “as available,” without warranties of any kind, express or implied. The History Cat disclaims all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, accuracy, and non-infringement. The History Cat does not warrant that the Materials will be error-free, uninterrupted, or compatible with all devices, platforms, or systems.
Notwithstanding the foregoing, a full refund may be issued at The History Cat’s discretion if a material technical or access issue cannot be resolved after reasonable, good-faith efforts by both parties to remedy the problem.
VI. Limitation of Liability
To the maximum extent permitted by law, The History Cat shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the use or inability to use the Materials. In no event shall The History Cat’s total liability exceed the amount paid by the user for the applicable license.
